Platform Privacy Policy

The Platform located at safariportal.app, and others via domain masking, (the “Platform”) is operated by Safari Portal LLC (hereinafter may be referred to as “us,” “we,” and “our”). Safari Portal LLC has created this privacy policy to demonstrate our commitment to the privacy of our visitors and customers. Safari Portal LLC  is committed to respecting your privacy and recognizing your need for appropriate protection and management of personally identifiable information you share with us (the phrases “personally identifiable information” and “personal information” may mean any information by which you, individually, can be identified or singled out, such as your name, address, telephone number, etc.). The purpose of this privacy policy is to inform you how we use such information when you visit our Platform.

This Privacy Policy applies to all users of Safari Portal, including unregistered visitors and registered users (Travel Agencies & Tour Operators, Suppliers & Property Owners, Travelers & Traveler's Guests).

This Privacy Policy also governs the collection, use, transfer, and processing of your personal information. By using this Platform, you consent to our Privacy Policy set out below. All terms not defined in this document have the meaning ascribed to in the Platform Terms and Conditions of Use located at safariportal.app. 

Safari Portal LLC is a United States Corporation subject to the laws of the United States. Since our servers are located in the United States, your data may be transferred to, stored, or processed in the United States. By using our Services, you understand and consent to the collection, storage, processing, and transfer of your data to our facilities in the United States and those third parties we share your data with as described in this Policy and our Terms and Conditions of Use.

A Special Notice about Children

Children (under the age of 18) are not eligible to use the Platform unsupervised, and we ask that children do not submit any personal information to us. If you are under the age of 18, you may only use this Platform in conjunction with, and under the supervision of your parents or guardians.

Users Under 13 Years of Age

The Platform is not directed to children under the age of 13. We strive to educate parents and legal guardians about how to appropriately safeguard their privacy and that of children under the age of 13 when using our Services. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access and/or use our Services. Children under the age of 13 are not eligible to use the Platform at all. Only parents or legal guardians can submit personal information to us about a child. 

By visiting our Site and/or using our Services, or by including children under the age of 13 years old in our provided services, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. 

If we learn we have collected Personal Information from a User under the age of 13 without parental consent, or if we learn a User under the age of 13 has provided us Personal Information beyond what we request from him or her, we will delete that information as quickly as possible. 

You should contact the Travel Agency if you believe that we have mistakenly or unintentionally collected information for a child under the age of 13. By using the Services, you are representing to us that you are not under the age of 13.

General

We may collect and process certain personal data from you, including the following:

If you are a visitor:

In general, you may visit the Platform without telling us who you are or revealing any of your personal information.

However, Safari Portal LLC  may collect information submitted via the “Contact Us” form, requesting or downloading one of our publications, sending us an email, telephoning us, or by subscribing to our newsletters. Whether or not you choose to provide personal information is entirely up to you.

If you are a registered user (Travel Agency):

Safari Portal LLC may collect information submitted via the Platform “Sign Up” form, the Platform “Login” form, and the Platform “Account Settings,” or via email or other communication mechanisms, such as name, last name, and Travel Agency you are representing, when you interact with us. 

If you are a Traveler or Traveler’s guest:

When you use the Platform, you may provide Safari Portal LLC with personal information. We only collect this information exclusively on behalf of the Travel Agency and under their instructions. This means that the Travel Agency is in control of the data you upload on the Platform.

For such purposes, Safari Portal LLC is considered a Data Processor and the Travel Agency is considered a Data Controller. As a Controller, the Travel Agency is responsible for complying with the requirements for Controllers under the General Data Protection Regulation (when the Travel Agency processes data of data subjects in the EU) or other regulations depending on the jurisdiction where the Travel Agency operates.

In addition, some information may have already been collected from you by the Travel Agency and entered into the Platform. If you want this information to be deleted, or rectified, or if you want to exercise any right that a data subject has (more about your rights can be found below in this Privacy Policy) please contact your Travel Agency. If Safari Portal is asked by the Travel Agency for any information belonging to you to be erased or rectified, Safari Portal will respond without undue delay.

The information collected may include personal information such as your name, email, phone number, mobile number, and date of birth. Personal information related to your travel might also be included such as your passport, any special occasion you are celebrating, flight and transfer information, itinerary, and travel insurance information.

Additionally, some sensitive information may be collected from you such as weight, medical and allergies information, dietary and beverages requirements/restrictions, and children's information. If you do not wish to share this information, please contact your Travel Agency.

Information Collected Automatically

Tracking technologies and Cookies. Safari Portal LLC may track the domain address from which you visit the Platform through cookies (see “Cookies” Section below), analyze this data for trends and statistics, and use the information for internal marketing purposes. Safari Portal LLC will never sell your information to third parties.

Statistical and usage information. We may gather statistical information from Platform visitors and analyze this data for trends and statistics (“Statistical Information”).

Information Collected from Third Parties

Marketing. Safari Portal LLC may collect Personal Information from lead enhancement companies with the purpose of improving the service offered. Safari Portal LLC may also collect information from advertising and marketing partners in order to monitor, manage and measure ad campaigns.

Use of Personal Information

Safari Portal LLC may use your Collected Information in the following ways:

Manage our relationship with you. Safari Portal LLC may use your Contact Information to provide information that you have requested, provide services you have requested, send you a requested publication, or send you our news articles as published if you have subscribed to our feed. Specifically, we may use your email address and phone number to contact you. Any Customer Information that you disclose to us may be used to respond to your inquiries submitted to us.

 Improve our Services. We may use Statistical Information to help diagnose problems with and maintain our computer servers, to manage our Platform, and to enhance our Platform and services based on the usage pattern data we receive. We may generate reports and analysis based on the Statistical Information for internal analysis, monitoring, and marketing decisions. We may provide Statistical Information to independent third parties for marketing purposes, but when we do so, we will not provide them with any personal information. 

Comply with applicable laws and regulations. We may also disclose your personal information to comply with a court order, subpoena, search warrant, or other legal process; to comply with legal, regulatory, or administrative requirements of any governmental authorities; to protect and defend Safari Portal LLC, its subsidiaries and affiliates, and their officers, directors, employees, attorneys, agents, contractors, and partners, in connection with any legal action, claim, or dispute; to enforce the Terms and Conditions of Use of the Platform; to prevent imminent physical harm; and in the event that we find that your actions on the Platform violate any laws.

Lawful basis for Processing Personal Data

In order to collect, process and share personal data for the purposes described in this Privacy Policy, we may rely on the following lawful grounds:  

  • performance of a contract or steps to enter into a contract with you, for example when we provide you with a travel proposal builder; 

  • your consent, for example, where you have opted-in to receive our marketing information, we may use your information to send you news and newsletters, special offers, and promotions, or information we think may interest you;

  • our legitimate interests or of a third party, provided those interests are not overridden by your interests or rights such as processing data (e.g IP address) to protect against cybersecurity threats 

  • legal obligation where we are bound by a piece of legislation to disclose your personal information, for example if a lawful request is received from a law enforcement agency.

We may process personal data on more than one lawful ground depending on the specific purpose for which we are using that data. We only use personal data for the purposes for which we collected it, unless we believe that we need to use that personal data for another reason that is compatible with the original purpose or as applicable law permits.

 

Data Integrity and Purpose Limitation

We only collect Personal Information that is relevant for providing the Services. We process Personal Information in a way that is compatible with providing the Services or as otherwise authorized by you. We take reasonable steps to ensure that Personal Information is reliable for its intended use, accurate, complete, and current. 

Cookies

The Platform may use cookie technology to improve the quality of your experience. A cookie is a small file that contains information sent by a Platform that is saved on your hard disk by your computer's browser. Cookies store information that a Platform may need in order to personalize your experience and gather Platform statistical data. Any time you visit the Platform to browse or to read or download information, cookies may collect and store the name of the domain and host from which you access the Internet (for example, msn.com, google.com, etc.); the Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access the Platform; and the Internet address of the Platform from which you linked directly to the Platform. We may use this information to measure the number of visitors to areas of the Platform, and to help us make the Platform more useful and interesting to our visitors. We may use cookies to gather statistical information about the Platform such as Platform visiting patterns to help target advertisements based on User interests.

Some consumers may not know that cookies are being placed on their computers when they visit Platforms. If you want to know when this happens, or to prevent it from happening, you can set your browser to advise you when a Platform attempts to place a cookie on your computer.

Do We Share Your Information?

We may only share your personal information with third-party independent suppliers for purposes of tracking information generated through the Platform for marketing purposes. If we engage a third-party independent supplier, they will be obligated not to use or share your personal information for unauthorized purposes. 

We will never sell, rent, or lease your personal information to a third party.

 

Transfer of Your Information

We reserve the right to transfer your personal information to a third party in the event of a transfer of all or substantially all of Safari Portal LLC  assets, provided that the third party agrees to adhere to the terms of this privacy policy. 

Data Retention

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law. 

Specifically, we will retain your Personal Information entered into your guest portal while we are providing services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;

  • To show that we treated you fairly; or

  • To keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

When it is no longer necessary to retain your personal information, we will delete or anonymize it.

Third-Party Hosting

We may contract with third parties to maintain and host the Platform. Any information you submit to us, including personal information, may be placed and stored on a computer server maintained by this third-party host. 

Platform Technologies

Safari Portal LLC  does not provide the technologies used to build this Platform, and therefore, neither recommends nor endorses the same. Any information regarding identified technologies, including their capabilities, limitations, and applications, should be sought directly from their manufacturers. Safari Portal LLC  hereby disclaims any rights to trademarks, service marks, trade names, logos, copyrights, patents, domain names, or other intellectual property interests of third parties.

Links to Other Material

The Platform may contain links to other Platforms, including but not limited to, Facebook, Twitter, LinkedIn,  Instagram, Stripe, and YouTube. These links and plug-ins are for your convenience. Platforms linked to and from the Platform are not necessarily under the control of Safari Portal LLC, and Safari Portal LLC shall have no responsibility or liability whatsoever for the content or privacy practices of any linked Platforms, or any link or linking program at any time. You should read and understand Safari Portal LLC  policies with respect to such third-party links, as stated in the Terms and Conditions of the Platform.

Security

The Platform uses commercially reasonable security measures to protect the loss, misuse, and alteration of the information under our control; however no system is impenetrable.  

We use reasonable and appropriate physical, electronic, and administrative safeguards to protect personal data from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the nature of the Personal Information and risks involved in processing that information.

We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

 

Privacy Rights Notice to California Residents

The State of California enacted the Shine the Light law (California Civil Code Section 1798.83) that permits users who are California residents to request certain information regarding the disclosure of certain “personal information” during the past year for marketing purposes. Right to Deletion      

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and

  • Direct any service providers to delete your personal information from their records.

Please note that we may not delete your personal information if it is necessary to:

  •  Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

  • Debug to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;

  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of [goods and/or services] to you, if that difference is reasonably related to the value provided to our business by your personal information.

Your Rights Under GDPR (if you are a data subject in the EU)

Under the law, you are granted six fundamental rights when data about you is being processed. We will ensure to reach out without undue delay (no more than 30 days) when you submit a request related to exercising your data subject rights. Although uncommon, when applicable for official or legal reasons we may be unable to address the specific request you make related to your rights. 

Also, if a request is manifestly unfounded or excessive, in particular because of their repetitive character, we may either:

a)   charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested; or

b)   refuse to act on the request.

In this scenario will we inform you of the reasons we believe your request is manifestly unfounded or excessive.

Effective Date and Changes

This privacy policy is effective as of August 30, 2021.  Safari Portal LLC  reserves the right to revise this Privacy Policy from time to time to reflect changes to our business, the Platform or Services, or applicable laws. The revised Privacy Policy will be effective as of the published effective date.

YOUR CONTINUED USE OF THE PLATFORM FOLLOWING OUR POSTING OF A CHANGE NOTICE WILL CONSTITUTE BINDING ACCEPTANCE OF THOSE CHANGES.
